California Advantage Escrow (“we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the rights you have over your information.
1. Information We Collect
We collect the following categories of personal information in the course of providing escrow services:
- Identifiers: name, postal address, email address, telephone number, date of birth, signature
- Sensitive personal information (as defined under California Civil Code §1798.140(ae)): Social Security number, driver’s license number, state-issued identification number, passport number, and financial account numbers together with any access credentials required to access the account
- Financial information: bank account and wiring instructions, mortgage and loan details, transaction amounts, payment records
- Real estate transaction information: property address, parcel number, title information, purchase or sale documentation
- Communications: records of emails, text messages, and written correspondence with our office
- Technical information: IP address, browser type, pages visited on our website, and cookie identifiers when you interact with our online forms
We collect this information from you directly (when you open an escrow, fill out a form, send an email, or call our office), from real estate agents and lenders involved in your transaction, from public records (recorder’s offices, tax assessors), and from third-party service providers we use to verify identity, process payments, or close transactions.
2. How We Use Your Information
We use your personal information for the following business and commercial purposes:
- To open, process, and close your escrow transaction
- To verify your identity and prevent fraud
- To communicate with you and the other parties to your transaction (real estate agents, lenders, title companies, attorneys)
- To send appointment reminders, milestone notifications, and document signing requests
- To comply with applicable laws, regulations, and audit requirements (including the California Department of Financial Protection and Innovation, IRS reporting, and anti-money-laundering rules)
- To maintain records as required by law and our professional standards
3. SMS / Text Messaging Program
Program Description
California Advantage Escrow operates an SMS messaging program for real estate professionals who have affirmatively opted in to receive text messages from us. The program is used to provide escrow service information, capability and availability messages, and business-development and marketing communications directed to real estate professionals where consent has been obtained.
Types of Messages
If you opt in, you may receive the following types of text messages from us:
- Introductions to California Advantage Escrow and our escrow services
- Capability and availability messages relating to residential and commercial escrow support
- Follow-up communications about working with California Advantage Escrow on real estate transactions
- Service-information and business-development messages directed to real estate professionals
How We Collect SMS Consent
California Advantage Escrow obtains SMS consent through website forms, client and contact forms, and direct business interactions in which a real estate professional provides their mobile number and agrees to receive text messages from us. SMS consent is collected as a separate, affirmative step — providing a phone number alone does not constitute consent. We do not send SMS messages to recipients who have not opted in.
Message Frequency, Rates, and Help
Message frequency varies; recipients typically receive no more than a few messages per month. Message and data rates may apply based on your mobile carrier’s plan — contact your carrier for details.

How to Opt Out
You may opt out of receiving SMS messages from us at any time by replying STOP to any message. You will receive one confirmation message and no further messages will be sent from that number unless you opt back in by replying START.
Mobile Data Non-Sharing Statement
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All text messaging originator opt-in data and consent will not be shared with any third parties. This restriction excludes text messaging originators, SMS delivery aggregators, and standard transactional platforms required to route the messages. SMS consent is not shared with third parties.
This restriction is absolute. There are no exceptions, and we do not condition continued participation in our SMS program on data-sharing consent.
4. How We Share Your Information
We share personal information with the following categories of recipients, and only for the purposes described:
- Parties to your transaction: the buyer, seller, real estate agents, lenders, title insurance company, attorneys, and other professionals involved in closing your escrow
- Service providers: companies that help us operate our business, including document signing platforms, identity verification services, SMS messaging providers, payment processors, IT and cybersecurity services, and accounting / audit firms
- Government agencies and regulators: as required by law (IRS 1099 reporting, FinCEN beneficial-ownership reporting, DFPI examinations, court orders, subpoenas)
- Public record: certain transaction documents (deeds, mortgages, reconveyances) are recorded with the county recorder’s office and become public records by operation of law
What We Do Not Share
We do not sell your personal information. We do not share your mobile opt-in data or SMS consent with third parties for marketing or promotional purposes — this restriction applies without exception.
5. Your California Privacy Rights
Under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), California residents have the following rights regarding their personal information:
- Right to Know / Access: Request the categories and specific pieces of personal information we have collected about you in the preceding 12 months, the sources, the purposes, and the categories of third parties with whom we have shared it.
- Right to Delete: Request that we delete personal information we have collected about you, subject to legal exceptions (e.g., information we are required to retain for regulatory or audit purposes).
- Right to Correct: Request that we correct inaccurate personal information we maintain about you.
- Right to Opt Out of Sale or Sharing: We do not sell or share your personal information for cross-context behavioral advertising. Do Not Sell or Share My Personal Information.
- Right to Limit Use of Sensitive Personal Information: Direct us to limit the use of sensitive personal information (such as Social Security number, government ID, or financial account credentials) to the purposes necessary to provide the requested service.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights — we will not deny services, charge different prices, or provide a different level of quality of service.

6. Data Retention
We retain personal information for as long as needed to provide services and to comply with our legal, regulatory, and audit obligations. Escrow transaction records are retained for a minimum of five years following close of escrow as required by California Department of Financial Protection and Innovation regulations.
7. Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is 100% secure; we make commercially reasonable efforts to protect your information but cannot guarantee absolute security.
8. Children’s Privacy
Our services are intended for adults. We do not knowingly collect personal information from children under 16. If you believe we have collected information from a child under 16, please contact us and we will delete it.
9. Changes to This Policy
We may update this Privacy Policy from time to time. The “Last Updated” date at the top reflects the most recent revision. Material changes will be communicated through our website and, where appropriate, by direct notice.
